Court Agrees to Expedite AvalonBay Appeal

Arguments are scheduled to begin May 29.

 

A Mercer County Superior Court judge has agreed to AvalonBay's request to hear its appeal by May 1, 2013, according to NJ.com. Arguments are scheduled to begin May 29.

AvalonBay's plan to build a 280-unit devleopment on the former Witherspoon Street hospital site was rejected by the Princeton Regional Planning Board in December. Last month the company requested an expedited legal review befor its contract with the University Medical Center of Princeton expires on June 30.

"...if this Court does not reverse the Planning Board's denial no later than May 1, 2013, AvalonBay intends to terminate its contract and will effectively walk away from this commitment," AvalonBay's appeal read in part.

The judge will also allow the Fair Share Housing Center to weigh in on the issues regarding affordable housing needs in Princeton, NJ.com reported.
